Knowledgeable representation for clients seeking to wipe out their debts by filing for Chapter 7 bankruptcy

Filing for Chapter 7 allows you to erase debt for medical bills, credit cards and more. To be eligible for Chapter 7,  you must get past the “means test,” which determines if you make too much money to file a 7.  You automatically qualify if your household income is lower than the state’s median income. If your income is above median income, you will have to take the means test to see how much disposable income left over after deducting allowable expenses from your income.

Filing for Chapter 7 bankruptcy doesn’t mean you will be required to give up your property. In most cases, you will be able to protect your:

  • Home (unlimited in Kansas, up to a certain limit in Missouri)
  • Motor vehicle
  • Personal property
  • Pension and retirement accounts
  • Life Insurance policies

If you’re considering Chapter 7 bankruptcy, I make sure you are fully informed about the advantages and disadvantages before making the decision to file.

Helping clients reorganize their debts by filing Chapter 13 bankruptcy

Chapter 13 bankruptcy may be an option if you don’t qualify for the “means test” under Chapter 7 bankruptcy but still need assistance to pay your debts. This means that you still have a steady monthly income but are unable to keep up with your payments. By filing for Chapter 13, you can enter into a repayment plan that allows you to pay off a portion of your debt over a three- to five-year period, while keeping homes and vehicles, at which point the rest will be discharged. I understand how important keeping your possessions may be, especially your home and car. If you’re being threatened with a foreclosure or repossession, I will explain how a 13 can give you time get current on your mortgage or car loan and keep your home or car.

I work directly with each client to help them decide which type of bankruptcy filing will be best for them.
